A. Cancellation Policy

Introduction

Consumers in the Europian Union have a right of cancellation in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their self-employed professional activity:

Right of Cancellation

Customers from the European Union have the right to cancel this contract within 14 days without giving any reason.

The cancellation period is 14 days from the day on which you or a third party designated by you, who is not the carrier, has taken possession of the last item.

To exercise your right of cancellation, you must inform us (EasySleep GmbH, Messestr. 1, 3100 St. Pölten, Austria, Tel.: 0043720301230, Email: office@allesdaune.at) of your decision to cancel this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model cancellation form for this purpose, although this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your notification concerning the exercise of the right of cancellation before the cancellation period has expired.

Consequences of Cancellation

If you cancel this contract, we shall reimburse all payments received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive notification of your cancellation of this contract.

For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees as a result of this reimbursement.

We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs first.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the cancellation of this contract.

The deadline is met if you dispatch the goods before the fourteen-day period has expired.

You shall bear the direct costs of returning the goods.

You shall only be liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

Exclusion or Premature Expiry of the Right of Cancellation

The right of cancellation does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual choice or decision by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.

The right of cancellation does not apply to consumers who, at the time the contract is concluded, do not belong to a Member State of the European Union and whose sole residence and delivery address are outside the European Union at the time the contract is concluded.

Linked/Financed Transactions

If you finance this contract by means of a loan and later cancel it, you will also no longer be bound by the loan agreement, provided that both agreements form an economic unit.

This is particularly assumed to be the case if we are also your lender or if your lender makes use of our involvement with regard to the financing.

If the loan has already been paid to us when the cancellation becomes effective or when the goods are returned, your lender shall assume our rights and obligations arising from the financed contract in relation to you with regard to the legal consequences of the cancellation or return.

The latter does not apply if the present contract concerns the acquisition of financial instruments (e.g. securities, foreign currencies or derivatives).

If you wish to avoid contractual obligations as far as possible, exercise your right of cancellation and also cancel the loan agreement if you are entitled to a right of cancellation in respect of that agreement as well.
