A. Cancellation Policy

Introduction

Consumers are entitled to a right of withdrawal as follows, where a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed:

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you or a third party designated by you, who is not the carrier, took possession of the last goods.

To exercise your right of withdrawal, you must inform us (EasySleep GmbH, Messestr. 1, 3100 St.Pölten, Austria, Tel.: 0043720301230, E-Mail: office@allesdaune.at) by means of a clear declaration (e.g., a letter sent by post or e-mail) of your decision to withdraw from this contract. You can use the attached sample withdrawal form, which is not mandatory.

To comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.

Consequences of Withdrawal

If you withdraw from this contract, we must repay all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged fees for this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period.

You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their quality, characteristics and functionality.

Exclusion or premature expiry of the right of withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer.

The right of withdrawal does not apply to consumers who are not citizens of a member state of the European Union at the time of the conclusion of the contract and whose sole residence and delivery address at the time of the conclusion of the contract are outside the European Union.

Interconnected/financed transactions

If you finance this contract through a loan and later withdraw from it, you are no longer bound by the loan agreement either, provided that both contracts form an economic unit. This is to be assumed in particular if we are simultaneously your lender or if your lender makes use of our cooperation with regard to the financing. If the loan has already been disbursed to us upon the withdrawal becoming effective or upon the return of the goods, your lender shall assume our rights and obligations from the financed contract in relation to you with regard to the legal consequences of the withdrawal or return. The latter does not apply if the present contract has as its object the acquisition of financial instruments (e.g. securities, foreign exchange or derivatives). If you wish to avoid a contractual obligation as comprehensively as possible, exercise your right of withdrawal and also withdraw from the loan agreement if you are also entitled to a right of withdrawal for it.
